1. Introduction
These terms and conditions govern the contractual relationship between Perú Top Experience Tour Operator, hereinafter referred to as “the Agency,” and the client, in relation to the tourist services offered, which include travel packages throughout Peru, full-day excursions, and trekking activities in the Cusco region, such as the Inca Trail, Salkantay, among others. Booking any of our services implies full acceptance of these terms and conditions, which may be updated periodically.
2. Services Offered
The Agency specializes in offering:
- Travel Packages: Including transportation, accommodation, meals, and guided tours.
- Full Days: Full-day excursions to various tourist destinations in Peru.
- Trekking and Hikes: Guided excursions on renowned trekking routes such as the Inca Trail and Salkantay, among others, with camping options and logistical support.
- National and International Flight Booking: At Perú Top Experience, we also help our clients quote and/or purchase national or international flights with the assistance of our expert experience designers.
- Travel Experiences Throughout Peru: Peru is a magical and enigmatic country with many places to discover. There are numerous adventure and adrenaline activities such as paragliding, overflights, rafting, among others.
3. Bookings and Payments For any booking on our website
you must provide all requested passport details at the time of booking (full name, passport number, date of birth, nationality, gender). Once we obtain payment confirmation, we will check availability and secure the necessary permits. Only after confirmation from a member of the Peru Top Experience team is your tour 100% confirmed.
- Booking Process: To confirm a booking, the client must provide the required information and make an initial deposit of 25% of the total tour cost. The booking confirmation will be issued once the deposit is received, and a receipt will be sent to the client.
- For International and Domestic Flight Purchases: To purchase a flight ticket, you must provide the required information and make a 100% deposit of the total cost. Confirmation will be issued once the deposit is received, and a receipt and tickets will be sent accordingly.
- Final Payment: The remaining balance can be paid upon your arrival in Cusco in cash only, and we request that it be paid at least 36 hours before your tour departs. If you are unable to arrive in Cusco this far in advance, please notify our sales team to make the necessary arrangements.
- Payment Methods: We accept payments via:
- Payments through our website or payment link with the following cards: VISA, Mastercard, American Express, Diners Club. (With We Travel, Izzi Pay, and Niubiz)
- Payments through Western Union or Money Gram agents.
- Bank transfer deposits.
- Fees: All payment methods incur fees, which vary depending on the method. It is important to note that the client is responsible for these costs (current estimated fee: 5.5%).
- Rates in USD: All rates are expressed in US dollars and include taxes and fees applicable to foreign tourists. (*)
4. Cancellation and Refund Policies Peru Top Experience Web
- Cancellation by the Client:
- If you cancel within 30 days prior to departure: You must pay 50% of the total cost of the trip, non-refundable initial deposit.
- If you cancel between 10 and 29 days prior to departure: You must pay 60% of the total cost of the trip, non-refundable initial deposit.
- If you cancel within 9 days prior to departure: You must pay 100% of the total cost of the trip and no refund will be made.
We recommend that you carefully review our cancellation policy before making your reservation to ensure that you are happy with these conditions. If you have any questions or concerns about the policy or your trip, please do not hesitate to contact us for further information.
- Cancellation by the Agency: The Agency reserves the right to cancel or modify a tour due to unforeseen circumstances, such as extreme weather conditions, political instability, or natural disasters. In the event of cancellation, the client will be offered a similar alternative tour, a rescheduling at no additional cost, or a full refund.
5. Client Responsibilities
- Travel Documentation: It is the client’s responsibility to ensure they have a valid passport or identification document, visas, permits, and other necessary travel documents. The Agency is not responsible for denied entry to a country or tourist attraction due to incomplete or incorrect documentation.
- Physical and Health Condition: Trekking tours require good physical and health condition. The client is responsible for ensuring they are in suitable condition to participate in the tour activities. The Agency must be informed of any medical conditions, allergies, or special dietary requirements at the time of booking.
- Travel Insurance: It is recommended that all clients purchase travel insurance that covers cancellations, medical emergencies, evacuations, and loss of personal belongings. The Agency is not responsible for any costs incurred due to inadequate insurance coverage.
- Compliance with Rules: The client agrees to follow the guide’s instructions during the tour and to respect local, environmental, and cultural norms. Any inappropriate or illegal behavior by the client may result in the termination of the tour without the right to a refund.
6. Agency Responsibilities
- Tour Organization: The Agency is responsible for providing the contracted services as described in the itineraries, ensuring their quality and safety. However, the Agency is not responsible for necessary itinerary changes due to circumstances beyond its control, such as natural disasters, acts of war, or adverse weather conditions.
- Guides and Equipment: The Agency will provide experienced guides and adequate equipment for the tours. The safety of participants is a priority, and the Agency will take all necessary precautions to ensure it.
- Transportation and Accommodation: The Agency selects transportation and accommodation providers with high-quality standards. However, the Agency is not responsible for any inconvenience or dissatisfaction with third-party services, although it will work to resolve any issues that arise.
7. Changes and Modifications
- Client Change Requests: Requests for changes to the booking (dates, itineraries) must be made in writing. All requests are subject to availability and may incur additional charges. The Agency does not guarantee acceptance of change requests made less than 24 hours in advance.
- Itinerary Changes: The Agency reserves the right to make changes to a tour itinerary to enhance the experience or due to unforeseen circumstances. These changes will be communicated to the client as soon as possible, and alternatives will be sought to maintain the quality and satisfaction of the service.
8. Luggage and Personal Belongings
- Luggage Restrictions: Clients must adhere to the luggage restrictions indicated for each tour. The Agency is not responsible for the loss or damage of personal belongings during the tour.
- Valuables: Clients are advised not to bring unnecessary valuables during the tours. The Agency is not responsible for the loss, theft, or damage of valuables during the tour.
9. Photography and Use of Images
By participating in any of the activities offered by Peru Top Experience, the client expressly grants the Agency permission to capture and use any images, photographs, and videos taken during the tour for promotional, advertising, and marketing purposes. This includes, but is not limited to, use in brochures, online marketing, and social media platforms.
The client acknowledges that they will not receive any financial or other compensation for the use of such images, photographs, or videos. This consent is given freely and without expectation of any benefit in return. However, if the client does not want Peru Top Experience to use their tour images for promotional purposes, they must inform their Experience Designer via email or WhatsApp before the trip.
10. Privacy Policy
The Agency respects its clients’ privacy and is committed to protecting the personal information provided. The collected data will be used solely to process bookings and provide information related to the contracted tours. We will not share the client’s information with third parties without prior consent, except as necessary for service delivery.
11. Complaints and Claims
Any complaint or claim must be communicated to the Agency (specifically to your experience designer) as soon as possible during the tour to allow for prompt resolution. Complaints submitted after the tour has ended will be considered, but the Agency does not guarantee a satisfactory resolution if it was not informed in a timely manner. The Agency is committed to handling all complaints fairly and professionally.
12. Applicable Law and Jurisdiction
These terms and conditions are governed by the laws of the Republic of Peru. Any dispute arising in connection with these terms will be resolved before the competent courts of Cusco, Peru.
13. Inca Trail Trekking Policies
- Permits
When booking the Inca Trail with Peru Top Experience and other agencies, you obtain a specific permit exclusively in your name. Please consider the following:
- Non-transferable: Once obtained, these permits cannot be transferred to any other person.
- Non-refundable: These permits are non-refundable. If for any reason you cannot complete the hike, you will lose the deposit for the permit.
- No Date Changes: After purchase, it is impossible to change the dates of your permit.
- Government Regulations: Please note that Peru Top Experience (or any other travel agency) does not set these conditions. They are regulations imposed by the Peruvian government.
- Alternative Arrangements:
If for any unforeseen reasons such as natural disasters, the “Inca Trail to Machu Picchu” is declared closed, Peru Top Experience will provide an alternative hike to ensure that your experience remains intact.
- Student Discount:
- $20.00 discount
- Student discounts apply to anyone aged 17 or under, and we require a copy of your valid passport at the time of booking.
